This is because the Commerce Clause provides limited protection to those who engage in activities that facilitate speech. This limited protection is also encumbered by the presence of interstate and foreign elements in these cases.
The Federal Communications Commission is also responsible for the common carriers, which means it can stop providing facilities. It may also discontinue leasing them. However, the federal government does not have the legal authority to stop the FCC from allowing the leasing of facilities for gambling.
